General terms and conditions of business

The following terms and conditions are applicable for all orders granted to the seller TFS TUNED FOR SPORTS AG. The written form is required in all cases unless otherwise agreed.

All prices are listed in Swiss Francs and include statutory value added tax unless stated otherwise.

The transport costs are not displayed or calculated in the shop. The transport costs will only be calculated after the shipment and will be invoiced to the buyer.

The shipping of goods from the TFS TUNED FOR SPORTS AG warehouse is carried out by courier service or post after receipt of payment. Risk passes to the customer with provision of the goods for shipping. Claims for damages due to delayed delivery are excluded.

The delivered goods remain the property of the seller until receipt of payment in full.

Exchanges and claims can only be considered within 8 days after receipt of the goods. Withdrawal must be made in writing or via return of the goods delivered. All returns must be accompanied by a copy of the invoice / order documents. The goods must be in their original packaging and unused.

The products are subject to errors, price changes or minor modifications. The colour of the items depicted may vary.

TFS TUNED FOR SPORTS AG shall be responsible exclusively for damage caused deliberately or due to gross negligence. Any liability is excluded for TFS TUNED FOR SPORTS AG for direct, indirect or consequential damage loss of profits or loss of earnings, insofar as this is permitted by law.

We only store data that are required in the context of business transactions. The purchaser explicitly grants the seller the right to use the data for their own advertising purposes. The seller is obliged to treat all personal information as confidential and must not disclose this to third parties.

Advance payment: if payment is not made within 8 days the order is cancelled.

The place of jurisdiction for both contract parties is Kirchberg / SG.

Shipping information

The shipping of goods from the Conte Sports / TFS TUNED FOR SPORTS AG warehouse is carried out by courier service post or truck. Risk passes to the customer with provision of the goods for shipping. Claims for damages due to delayed delivery are excluded.

Special instructions for shipping abroad:

For deliveries abroad, customs duties, taxes and other fees may apply, which are not included in the total price. These costs shall be borne in full by the customer.

Data Protection

1. General Data Protection Statement

The protection of your personal data is important to us. As such, we process your personal data exclusively in accordance with the legal requirements. This data protection statement sets out the personal data that is gathered as a result of your use of our website and online shop, and the purposes for which this data is used and processed. By using these services, users consent to the collection and processing of their pesonal data to the extent set out in this data protection statement.

We collect personal data when you voluntarily disclose it to us as part of your order, or when you make contact with us (e.g., by using the contact form or e-mail), or when you open a customer account. The nature and extent of the personal data that is collected can be seen from the relevant data entry from. We only use the data that you provide in order to fulfil our contract and to process your enquiries. We store this data in a database on our server and use it exclusively for individual communication with you and/or to fulfil the contract.

3. Purpose of processing

Contesports processes the personal data it collects primarily to fulfil its contractual obligations and to deliver its services. This may involve the processing of orders, returns and payments and the provision of customer service.

4. Use and disclosure of personal data

If you engage us to provide goods or services, your personal data will only be used without your express consent to the extent that such use is necessary to provide the goods or services or to fulfil our contractual obligations. This may include the disclosure of your data to shipping companies to complete a delivery, or to credit companies or payment providers to process payments, or to third parties to fulfil our contractual obligations or to deliver our services.

5. Advertising and newsletters

Contesports is entitled to make use of the user data that is collected for its own marketing and advertising purposes. This applies to data that the user has provided orally, in writing, or by electronic means. If you sign up for our newsletter, we use the information that is required (or that is specifically disclosed by you) to send our newsletter to you on a regular basis, in accordance with the consent that you have given. You may unsubscribe from the newsletter at any time and may do so by following the link provided in the newsletter for that purpose.

6. Use of cookies

In order to give our website an attractive design and to enable a particular functionality to be used, we make use of so-called cookies on a variety of pages. These are small text files that are saved to your end user device. Some of the cookies that we use are deleted by us once your browser session has ended, i.e., once you close your browser (known as session cookies). Other cookies remain on your device and enable us to recognise your browser next time you visit the site. 7. Web analytics tools

In order to continuously improve our online offering, we make use of so-called tracking technologies. You can prevent cookies from being saved to your device by configuring your browser software; however, we draw your attention to the fact that, if you do this, you may not be able to use the full range of features offered by this website. 8. Use of Plug-Ins

So-called social media plug-ins are integrated into our website, from providers such as Facebook. This program can be recognised by the logo of the relevant social network. No connection to social network servers is created simply by accessing our site, as the logos are merely a graphic representation. You will only be redirected to the actual plug-in by clicking on the logo. If you use the plug-in, a connection to the network will be created, and the data of the image that you wish to share with your friends will be transmitted to the social network server. If you are logged in when using this plug-in, your visit will be recorded directly against your user account. In this case, you will no longer be notified of the consequences of accessing the data or the content of the data to be transferred. You may find details of the exact scope and purpose of the collection of data by each social network, its further use of this data, and any configuration options that may be available in respect of your user account by referring to the relevant network's own data protection statement.

9. Obligation to store/delete data

Contesports will retain users' personal data for as long as appropriate or necessary to comply with applicable laws, or for as long as necessary to fulfil the purpose for which it was collected. Contesports will delete personal data as soon as it is no longer required and in any event upon expiry of the legally specified maximum retention period.

10. Right to be notified, right to require deletion or correction, and right to object

Users are entitled, by making a request in writing and providing a copy of an official identification document, to receive information about the personal data held about them at any time. Moreover, users have the right to correct their personal data, if this data is inaccurate or outdated. They are further entitled to require the deletion of their personal data. This entitlement is, however, subject to any legal or contractual obligation. Finally, users have the right to object to the processing of their personal data at any time.
